These Terms & Conditions (“Agreement”) govern your access to and use of the services provided by Sunny Day Behavioral, LLC (“SDB,” “we,” “our,” or “us”), including Applied Behavior Analysis (ABA) therapy, Zoom sessions, website usage, communications, and associated platforms. By accessing any of our services or registering for a Zoom event hosted by Sunny Day Behavioral, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using our services, websites, applications, or participating in Zoom-hosted events, you:
Affirm you are over 18 or a legal guardian of the child receiving services.
Consent to all data policies in our Privacy Policy and HIPAA Notice.
Agree to irrevocably release certain rights to data, content, and intellectual materials as outlined.
Agree to be bound by these Terms & Conditions and the specific terms related to Zoom registration events.
2. Scope of Services
SDB provides:
ABA therapy and consulting services
Parent/caregiver training
Data collection, assessments, reports, and progress evaluations
Zoom-hosted professional development and education events
Communication through secure portals, forms, texts, emails, or Zoom
Services may be rendered in homes, schools, community settings, or virtually via Zoom depending on plan approval.
3. Eligibility
Services and event access are provided only to clients and participants:
With completed intake or registration documentation
Who meet clinical criteria for ABA (for therapy clients)
Whose funding source has authorized services (for therapy clients)
We reserve the right to discontinue services or revoke Zoom access for any non-compliance, fraud, disruptive conduct, or safety issues.
4. Appointments & Cancellations (for ABA clients)
Sessions must be canceled with at least 24 hours’ notice unless an emergency occurs
More than three missed sessions without notice may result in discharge
Repeated cancellations may trigger clinical and funding source review
5. Consent to Recording & Observation
You agree that:
Sessions or events may be observed live or recorded for supervision, quality assurance, training, or documentation
Zoom sessions may be recorded by SDB for internal use only
Materials submitted (e.g., video responses) may be used for internal development or compliance
No personally identifiable information will be used for external marketing without written consent
6. Financial Responsibility (for therapy clients)
You are responsible for:
Any co-pays, deductibles, or charges not covered by insurance
Updating insurance or billing information within 5 business days of any change
Providing accurate authorization and payment details
Failure to comply may result in account suspension or collection procedures.
7. Intellectual Property & Content Ownership
All materials, content, and instructional media presented during sessions or events (live or via Zoom) are the exclusive intellectual property of Sunny Day Behavioral. You agree that:
You will not copy, distribute, record, alter, or resell any materials without written permission
All session or event content, including recorded segments, remains SDB property
All custom forms, training, or tools developed through service are owned by SDB
8. Data Use, Privacy & Confidentiality
By participating in our services or Zoom sessions:
You authorize us to collect, retain, and analyze relevant data for internal compliance, insurance, and training
You acknowledge that personal data may be stored securely and protected by encryption
You waive the right to share participant details, screenshots, or recordings from Zoom sessions
You may request access, correction, or deletion of your data by contacting info@sunnydaybehavioral.com
9. Limitation of Liability
To the fullest extent permitted by law:
SDB is not liable for incidental, indirect, or consequential damages from service or Zoom usage
You waive class-action rights and any claim to punitive damages
10. Modifications
We may modify these Terms, our pricing, or service structure without notice. The latest version is posted on www.sunnydaybehavioral.com and is effective immediately upon publication. Continued use of services or event attendance constitutes agreement.
11. Severability
If any portion of this Agreement is found to be unenforceable, all remaining sections remain valid.
12. Governing Law
This Agreement is governed by the laws of the State of Florida. Any dispute shall be resolved through binding arbitration in Miami-Dade County, FL.

Sunny Day Behavioral - Privacy Policy

We collect the following from clients and event registrants:

Session attendance or participation details
Information submitted via intake or Zoom registration forms
2. How We Use Your Data
Your information is used to:
Communicate service details and session invites
Track attendance and engagement
Submit documentation for insurance or compliance
Deliver resources or session materials
3. Data Sharing & Protection
We never sell your data.
Data is stored securely on encrypted platforms.
Access is limited to authorized personnel and vendors with signed agreements.
4. Zoom Recordings
Some events may be recorded for documentation, review, or staff development. Attendees will be notified. To opt out, disable your camera/mic or decline participation.
5. Cookies & Tracking
We do not use cookies on registration forms. Zoom may use its own analytics per its policy.
6. Your Rights
You may contact us to view, correct, or delete your data at any time.
7. Children’s Privacy
We do not knowingly collect information from children under 13 unless through verified guardian consent.
8. Policy Changes
We may update this policy. The current version will always be published at sunnydaybehavioral.com.

These Terms & Conditions (“Agreement”) govern your access to and use of all employee-designated services, platforms, Zoom meetings, communications, forms, and content provided by Sunny Day Behavioral, LLC, a Florida-registered S-Corp (“SDB,” “we,” “our,” or “us”).
By registering for or accessing our staff systems, you confirm that you are a current employee, contractor, or authorized affiliate of Sunny Day Behavioral, and you agree to the legal terms set forth below, including the integrated Non-Disclosure Agreement and staff conduct provisions.
1. Staff-Only Access
This portal is intended exclusively for staff employed or contracted by Sunny Day Behavioral. You may not:
Share your login or access credentials with any third party
Allow family, friends, or outside entities to use your credentials
Download or transmit documents outside of approved platforms
Unauthorized access or sharing is grounds for immediate termination and potential legal action.
2. Confidentiality & Non-Disclosure Agreement (NDA)
By accessing this staff portal, you agree to the following:
All information, including client data, assessments, treatment plans, videos, forms, communication logs, training documents, and internal communications, is strictly confidential and owned by SDB.
You will not disclose or transmit any confidential or proprietary information to outside parties—verbally, digitally, or in writing—without express written consent from SDB leadership.
Confidentiality obligations survive the end of your employment or engagement indefinitely.
You must immediately report any suspected data breach, HIPAA violation, or unauthorized access to admin@sunnydaybehavioral.com.
Violating this agreement may result in legal action, civil penalties, and immediate termination.
3. Professional Conduct Policy
SDB maintains a zero-tolerance policy for unprofessional or unlawful communication. You agree:
Not to make defamatory, slanderous, or misleading comments about clients, employees, vendors, or the company.
To refrain from gossip, client-specific discussion, or negative commentary on email, text, group chat, social media, or review platforms.
To maintain a professional tone in all internal and external interactions.
To uphold integrity when representing SDB in person or online.
4. Social Media Restrictions
You may not:
Post client photos, documents, materials, or treatment information
Use our logo, training tools, or assessment images in personal posts
Reference SDB clients or staff in TikTok, Instagram, Facebook, Snapchat, Whatsapp, Threads, X (Twitter), or personal blogs without formal written approval
Make public statements implying ownership, authorship, or licensing rights to any SDB documents or systems
Violation may result in disciplinary action, contract termination, and legal recourse.
5. Ownership of Materials & Data
All materials provided during employment—including intake forms, assessments, electronic records, PDFs, parent training, program templates, session notes, and supervision logs—are the intellectual property of SDB and may not be copied, reused, or distributed without permission.
6. Privacy, HIPAA & Data Security
As an SDB staff member, you are responsible for safeguarding client data in full compliance with HIPAA and internal policies. This includes:
Logging out of all client-facing systems when not in use
Password-protecting your work devices
Not sharing PHI over personal texting apps, unencrypted email, or external cloud storage
Only using assigned emails and portals for official work
7. Zoom, Recording & Media Consent
You understand that:
Zoom sessions may be recorded for clinical supervision, internal training, or documentation
No personal devices may be used to record or photograph sessions
You may not store or transmit any recordings outside of approved systems
8. Dispute Resolution & Florida Compliance
This Agreement is governed by the laws of the State of Florida. You agree:
Any legal dispute will be resolved via binding arbitration in Miami-Dade County
SDB is not liable for indirect, incidental, or consequential damages
You waive the right to class-action claims or public legal forums
9. Staff Termination or Exit
Upon the end of your employment:
You must delete all SDB materials in your possession
You are not permitted to reuse or adapt programmatic or clinical content in future roles
Your login access and device permissions will be immediately revoked
Your confidentiality and NDA obligations remain active and enforceable
10. Policy Updates & Modifications
We may update these Terms from time to time. You will be notified through our portal, email, or direct communication. Continued use of this system implies agreement with all revisions.
